we signed up with TAPA last year & these people have done a very good job. The rings have reduced to nearly nil & three invoices we got with charity firms were withdrawn by 'em soon after we opted out with TAPA. I am confused at the above comments. these people are a good firm.

TAPA are certainly not a scam. They have represneted me in court against BCS Multimedia and won the case for me. BCS filed a claim against me for over £1300. It was Trading Standards that told me to instruct TAPA. The above comment is a malicious lie. TAPA are brilliant.

im with TAPA and they have got the calls right down for me. they are always there for me and have give me loads of councilling. i sent them 2 invoices that manchester charity scam houses sent me and they have told them to get lost on my behalf. they rang me and left about 6 abusive messages on my answerphone for about 2 days and since then they have never rang back. TAPA said that would happen. to all you low lifes that are on here posted nasty comments about TAPA, you should crawl back under your rock and stay there please.

Thought i would put in my two penneth here! Saw some of the malicious posts on this thread about TAPA and it boiled me up! I registered with them in June and the calls to my office and mobile have completely stopped. TAPA have done a very satisfactory job and i just want to reassure any business that is having difficulties with advertising firms that TAPA will get rid of the nuisance calls for you.

Evening all! Glad to hear you are all getting rid of those nuisance callers! I bet it was Mancs and Scoucers! I had a terrible time up until March this year myself till i got the TAPA ARMY on the case! Did anyone have trouble with a company in Liverpool called Independent Publications? They were the unsavoury characters that were passing my details around to all the scoucers and manky mancs! Just wondering if they shafted any of you lot?

Someone was passing my details around as well. It has happenend to a few other businesses on my street. TAPA investigated it and found it was a firm called Empire in Manchester that was doing it. As a result TAPA handed all the evidence over to the ICO that are responsible for the data protection act and they took over from there. Im just glad they stopped the calls coming through to my shop because im on my own most of the time and customers were walking out of the shop because i was constantly in the back room being abused on the phone by some Manchester charity publication house. I did not have trouble with Independent Publications. I know you say they were in Liverpool. I was getting targeted by the Manchester network of companies. The calls were finally stopped in early June and its stayed quiet since. I just hope it never starts back up again.

Hi Oliver. Empire tried scamming me as well! I paid them twice for two different adverts they insisted i agreed to some months earlier when i definately didnt but the pressure got too much so i paid.It must be a scam enterprise. TAPA got one payment back so far through MBNA and they are working on the other refund at the minute. Glad to hear you got it sorted as well.

How long was it before TAPA helped you recover your money back? They promised me it would take 30 days but it took nearly 7 weeks to recover my money through my card issuing banks. I suppose it was not TAPA's fault but they did estimate 1 month at the start. Should I be naffed off?

For those in doubt here are some extracts from TAPA's Term and conditions


5. The Service Provider will take the necessary action to ensure that unsolicited sales, market research, silent and recorded message telephone calls made to the Client from any UK based Telemarketing Firms are done so unlawfully within 30 days of the Agreement Date commencing. The Service Provider will achieve this by registering the Clients' particulars on to the various UK public opt out registers. The Service Provider agrees to carry out any necessary lawfully binding registrations on behalf of the Client each annum where necessary for the term of this Agreement.

So all they do is register you with TPS and Silentguard which are both free services


35. The Service Provider is not a legal practice and does not act in any legal capacity or is qualified legally. The Service Provider is an independent profit-making private organisation. The Service Provider does not work under contractual agreement or is licensed by any government department to carry out its day-to-day practice duties. The Service Provider is not associated and does not work in partnership with the Information Commissioner's Office (ICO), the Office of Communications (Ofcom) or the Telephone Preference Service (TPS).

They have no legal authority and have no powers to recover money on your behalf.

37. The Client shall not hold the Service Provider responsible if he receives any unsolicited sales or market research telephone calls. The Service Provider cannot accept responsibility if an unsolicited sales or market research telephone call is made to the Client and cannot guarantee that unlawful, non-UK regulated or unprofessional Telemarketing Firms will not contact the Client from time-to-time. The Service Provider will aim to prevent any further unsolicited sales or market research telephone calls from such Telemarketing Firms at which time the Service Provider is notified by the Client.

So they do nothing but take your money to register for something you can do for free.

That is another service they offer to the public my friend to do with general miscellaneous sales calls. This is a specialised business service they provide to businesses involved in legal disputes with charity sponsorship firms. They are absolutely brilliant and have saved me from the brink of despair. The calls have stopped and they got me my money back. Job done. End of. The free services you are on about have got nothing to do with the court cases they dealt with for me. Youve got it twisted my friend.

Just spoke to ian in the advertsinig standards authority ASA on 02074922222 and he has informed me that they have released a statment advising that they are aware of the advertisinig protectioin agency scam based in east cheshire and are aware that they are inpersonating them and advised me to contact east cheshire trading standards on 0300 123 55 00 to put a stop to these crooks

TAPA have recovered over £400 for me that i paid to advertising firms that never gave me my advertising. My local Trading Standards recommended TAPA to me when i was first conned by a Manchester firm. TAPA are a very good company.

TAPA have stopped sales calls to my shop. I was getting hounded by advertising firms for over 6 months and got TAPA to stop them. It didnt happen overnight but after about 2 & 1/2 weeks the calls dried up. I was getting around 7-10 sales calls a week. I dont understand the slanderous comments against TAPA?? Their customer service has been excellent!!?? Plus, just looked at the ASA adjudication and it just says a few people thought their service was free. If TAPA were bent they would be shut down by the ASA, so TAPA is clearly legit.

Read ASA ruling and all it says is one part of TAPA's website was slightly unclear and need to be clearer. It doesnt say they are under investigation or being shut down or bent. If ASA have been through their website and only come up with that conclusion, it proves beyond doubt that TAPA are legit! Otherwise the report would say so! I see on ASA website that millions of the UK's biggest firms getting rulings. This proves that TAPA are legit as ASA dont say otherwise.

Im not bothered about anything. They have stopped sales calls from idiots to my wife's hair salon and got two charity firms to withdraw their payment demands. As far as im concerned i will be staying with TAPA for a long time to come.

Anyone with half a brain can see the slanderous remarks about TAPA are posted by fakes. Or customers of theirs that havent paid their bills because they are losers and are now being spiteful because they are having to take them to court to recover their money.

All this about TAPA are a Scam etc, bores me silly. They have been around for years. Onviously they would have been shut down years ago. Only backward idiots would be believe the slander. Most of the malicious comments dont make any sense ad are clearly posted by muppets with low IQ's.

I was puzzled as to why I was receiving between 10 & 15 calls a month telling me I had agreed to sponsor various “good causes” in my local area by placing an order for advertising space in various books and wall-planners.

When I started to get a couple of invoices through from different companies all at very similar amounts I became suspicious.

I typed some of the company names in to Google and almost every time found the website for The Advertising Protection Agnecy. Being the only real source of information I decided to contact them.

I was glad to speak to somebody that finally explained what was going on, why it was happening and most importantly how it could be stopped. after an hour of discussion followed by an hour of reading their website it was quite clear the only real choice was to get registered, so I did.

That was 9 weeks ago and since then I can gladly report that I've had no calls for about 3 week's. Early on some of these cold call scammers put a considerable amount of fear in to me with threats of door step collection's, bailiff's, solicitors and court. Each time I had a problem I called my appointed representative and he explained why they made these threat's and completely calmed me down. TAPA really do know how to handle these firms.

My advice is simple, if you have the same problem I did, then visit the TAPA site, read their information, and if you are not sure about anything before joining just call them so TAPA can explain as they did with me.

Several tabs providing further information were included on the left side of the home page. Text on the home page stated "TAPA provides assistance with Nuisance Calls • Junk Faxes ... The Privacy and Electronic Communications (EC Directive) Regulations 2003 is a UK law that states all organisations including charities, voluntary organisations and political parties do not make sales or marketing calls to telephone numbers unless they have the owner's consent to do so". Further information was provided about the regulation. Text continued "The Advertising Protection Agency (TAPA) stops unsolicited advertising and marketing sales approaches being made to consumers and businesses by way of telephone, fax and email that do not wish to receive these types of unsolicited marketing approaches. Whether individuals wish to prevent any single one or all of these types of unsolicited marketing approaches being made to them, TAPA works to permanently prevent any further unsolicited marketing approaches being made to them in the future ...". A click through link labelled "STOP NUISANCE CALLS" WAS PROVIDED. Text at the foot of the page stated "Please browse the links below for terms and conditions".

The logo of the Telephone Preference Service appeared alongside the text "TAPA is an Associate Licensee of the Telephone Preference Service (TPS) and has demonstrated its commitment to raising and maintaining the standards and effectiveness of the direct marketing industry".

A click through link "Stop Nuisance Calls" led to a separate landing page, headed "Stop Nuisance Sales Calls, Market Research, Silent and Recorded Message Calls To Your Phone Number" and included information about that service. At the bottom of the page, at the end of the final paragraph, text stated "For further details, please see our Terms of Service regarding registration for only £2.25 per month for registering up to five numbers." Below that text, a click through link stated "Register Now".

On the Terms of Service webpage, under the heading "STOP NUISANCE CALLS", text stated "The Client shall pay an annual administration fee to the Service Provider of £26.95 inc VAT initially on the Agreement Date by way of credit / debit card payment to subsidise all associated time, stationary and utility costs, postage and packaging of documentation and any other costs that may be incurred by the Service Provider in processing a new Client instruction for the registration of up to five (5) telephone numbers. This fee is based on a monthly subsidy of £2.25 inc VAT per calendar month ... A further annual administration fee of £9.95 inc VAT (0.83p inc VAT per calendar month) will be due payable initially on the Agreement Date to register any additional telephone numbers above five numbers (6+)."

On the "Cancellation of Service" webpage, under the heading "Nuisance Calls & Junk Faxes", text stated "If you have instructed TAPA to stop miscellaneous sales telephone calls or junk faxes being made to your telephone number(s), you can cancel these services within 7 days of the date you instructed TAPA ..."

Issue
The ASA received four complaints:

1. three complainants challenged whether the website implied that The Advertising Protection Agency (TAPA) had official status; and

2. three complainants, who had registered with TAPA through their website to prevent nuisance calls, challenged whether it was sufficiently clear that TAPA charged for its services.

Response
1. The Advertising Protection Agency (TAPA) said that they had previously taken advice from the ASA on the content of their website and understood that it was in line with the advertising Code.

They said they had been trading with businesses since 2007 and had begun trading with consumers in May 2011. They said they were a service provider and did not retail physical goods and therefore felt the style and feel of the website needed to be one that would reflect their market and required a corporate feel that demonstrated professionalism, good academic standard and a less exciting layout than an online retail website. They questioned whether the complainant had confused 'corporate' with official.

They said they used a tick in their logo, because they viewed it as a positive symbol denoting confidence, good service, help and assistance as a service provider and a consumer champion that helped businesses that were being targeted by unlawful telemarketing firms. They said they had liaised closely with a large number of Trading Standards offices since 2007 as well as two major newspapers, the Police and Companies Investigation Branch, and the issue had not been not been previously raised by those governing authorities.

They said that the TPS logo appeared because TPS offered a service to businesses, screening all of their tele-data through their official checking service. They said they joined the scheme to show that they traded lawfully and screened all of their data through the TPS and would only ever contact a business that was not registered on to the TPS central opt out register. They said the scheme also encouraged accredited members to display the logo.

They commented on the display of their registered data controller number and said businesses that held individual personal data were legally obliged to register their business with the Information Commissioner's Office (ICO) and received a 'Registered Data Controller Number' under the Data Protection Act 1998. They explained that they had to display that number on their website so that the general public could verify with the ICO that TAPA were lawfully controlling personal data properly in accordance with legislation. They believed consumers would understand the relevance of the number.

They said they had a '100% Satisfaction Guaranteed' logo on every webpage and therefore felt the website would not be seen on an official or government website and that showed consumers that they were a business.

They suggested that the 'Cancellation of Service' link published on each webpage and their testimonial links also suggested they were a business. They said they also had a dedicated page of links which steered visitors to the TAPA website to government regulators where they could make complaints and get advice and that that was another indicator that they were a business. They said their FAQ link also explained their legal status.

They said their website also included the relevant law relating to unsolicited sales calls which made consumers aware of their legal entitlements.

2. They believed that the complainants had not carried out the necessary checks regarding their fees, for example, by not sufficiently studying the website or by contacting TAPA by one of the many means available on their website, and that the "Stop Nuisance Calls" webpage included a specific price, setting out the cost of the service. They said they had added their VAT Registration Number to every webpage, which they felt, in addition, showed that they were not a free service. They said the PayPal logo appeared on every webpage, which they felt was a clear indicator that they charged for their services, because a PayPal logo would be understood by consumers to mean that a website charged for its services or goods and did not offer free services. They said they also had a 'Terms of Service' link on every webpage, duplicated in two places, which featured a breakdown of all of the fees they charged. They said the website also contained a 'Cancellation of Service' link and a 'Disclaimer' link on each page and the content stated that they were a profit-making business. They also said the website did not state that they were a free service and they did not see why consumers should therefore assume that they were free. They said they also provided a helpline number on each webpage that could be contacted for clarification of their services and a thorough FAQ that answered questions about the charges for their service.

They said the cost of the service was also made very clear in the early stages of the contract and that after an order was placed online they posted an introduction pack to the customer that included a bill, a copy of their terms and conditions and a copy of the contract into which they had entered. They said they also provided their clients with a seven-day cooling off period as a gesture of goodwill, which they would not do if they were a company that intended to deceive consumers.

Assessment
1. Upheld

The ASA acknowledged that the website did not expressly claim to be an official government authority, agency, channel or other official body and also noted TAPA's view that the website contained information that would not typically be included in an official or governmental website, such as their VAT Registration Number, the PayPal logo, the claims "100% Satisfaction Guaranteed" and "Cancellation of Service" and that they also charged for the service.

However, we noted that the website offered to stop unsolicited calls and communications and considered that that was a service which consumers might expect to be offered by an official source, such as a government agency or department. We noted that the website contained a great deal of practical consumer information, which consumers might not typically expect to be included in a website for a commercial business. We also noted that the information was provided by an organisation called The Advertising Protection Agency, which we considered some consumers would infer was an official body.

Although we noted that some aspects of the website indicated that TAPA were not an official body, we considered that, in light of the name, service and content, the overall appearance of the site could lead users to infer it was an official government service and therefore concluded the ad was misleading.

On that point, the claims breached CAP Code (Edition 12) rules 3.1, 3.3 (Misleading advertising) and 3.41 (Imitation and denigration).

2. Upheld

We noted that some consumers had not realised from the website that there was a charge for TAPA's service and had signed up for the service on the understanding that it was free. We noted that TAPA had included the pricing information on the website, although it was not included on the main home page, but was found on a separate page, accessed via the link "Stop Nuisance Calls". We noted that the relevant pricing information appeared at the bottom of that second page above the link "Register Now" and stated "£2.25 per month for registering up to five numbers". We understood that consumers wishing to use the "Stop Nuisance Calls" service would have to click on the "Stop Nuisance Calls" and "Register Now" links, and would therefore go via the page which included the charging information and click the link just below the relevant text. We also acknowledged that the Terms of Service page included additional information about the cost of each available service to the user and that the website also included a tab with details of TAPA's cancellation policy, which the advertisers' felt further indicated that there was a charge.

However, we also noted that the charging information appeared at the bottom of a large block of text and that the website in general contained a great deal of information and several pages of lengthy and detailed text. We considered that, in light of that format, some consumers might miss information because details might be lost in the lengthy content included in the website's several pages.

Because the website contained a great deal of text over several web pages and because the significant pricing information was included in a large block of text, we considered that it might not be clear to some consumers there was a charge for TAPA's services. We therefore concluded that the website did not make sufficiently clear that TAPA charged for its services and was misleading on that basis.

On that point, the claims breached CAP Code (Edition 12) rules 3.1, 3.3 (Misleading advertising) 3.9 and 3.10 (Qualification).

There is no additional fee required for this service and TAPA provides this information in a unique, comprehensive guide to all businesses that instruct TAPA.


So all TAPA can do (maybe) is tell you how you maybe able to recover money. They can't actually do anything themselves because as they again say themselves in section 35 of their contract of service

The ASA seem to now be happy that the website complies now and that ruling is old? I notice many worldwide brand's have had ASA adjudications, are they crooked also?
Do what normal people do and read their website and if you need the services they provide good, if not, don't register! Simples!

so how do they help get you're money back if they are not a legal practice!! they have no statutory powers, they are not lawyers? what can they do that Joe Public can't do for free. Give advice? well that I can get for free from action fraud or the Citizens advice bureau.
I am curious so please enlighten us please to what they actually do.

These people took my Girlfriends credit card and took £380 pounds out of her account . God I wish we could have avoided this our whole family has suffered tremendously and we are seriously out of pocket . The citizens advice burea said these people are taking money illegally and the police are involved in trying to locate them.

i have been with tapa now for 2 years into my third year but beacause they say they could not get a hold of me they have taken a full years payment from my card which i did not authorise after emailing me an invoice for monthly payments i am now having to seek legal advice for my money back

I work for him at his restaurant in Wilmslow Sarafina. He said he's just employed as a consultant and is not the owner but Gregor that works here said he saw the business account once has got his name on the bottom of the bank statements so hemust be the owner.He comes in here too often anyway. He is a really nice person though and always polite and always gives me the time of day. I just don't get why he claims to just be an employee when he is,nt. I would want everyone to know if I owned a restaurant and would be proud. Anthony doesn't seem to give a 5hit.

I dated Anthony and he was an absolute gentlemen. A lovely, lovely guy. Very generous and surprisingly he put himself down a lot. It didn't work out because I thought he was hooked and started to think he needed me so I became demanding. Eventually he did what he warned and moved on. I genuinely believe that his first live is money and if you try getting in between that or upset him when at work you're a gonner. It's intriguing that so many people talk about him. He is extremely private and not public. Doesn't show off and pretends he's poor. He had a rough childhood and his mum died yet he just gets on with it. He has no one and I forgot that all too often and took his loyalty for granted. This guy don't cheat and has opportunity to. He can be a wanker but he gives you his time. Hope to hear from him again.
